What are the types of alimony?
Attorneys at our firm represent people who are seeking alimony payments and those who will be responsible for paying spousal support. During divorce proceedings, pendente lite support may be granted. This is a temporary support that often helps people during divorce proceedings. Gomperts, Braun & McDermott, LLC handles the four other types of alimony also, which are as follows:
- Reimbursement alimony - This type of alimony could apply to a situation where one spouse supported the other spouse through law school, medical school, business school or other type of graduate or post-graduate education. The supporting spouse will be reimbursed for that support.
- Rehabilitative alimony - This type of support could apply to a situation where a stay-at-home parent or homemaker intends on returning to the workforce after obtaining up-to-date job skills. The support may be higher during the rehabilitative period to ensure the other party can afford educational expenses.
- Limited duration alimony - This is generally applied to shorter term marriages where there is a disparity in marital contribution and earning power.
- Permanent alimony - This type of alimony is typically awarded in situations where there has been a longer term marriage, the stay-at-home spouse is older and each party wants to maintain a lifestyle that is reasonably similar to what was enjoyed during the marriage.
Equitable distribution of property
In New Jersey, property, assets and debts that were acquired during marriage will undergo an equitable distribution. Our firm strives for a fair distribution of assets and debts from the date of marriage to the date of filing for divorce, or an alternative date if the parties agree. Property can include real property, retirement assets, stock options, vehicles, personal property, IRAs and bank accounts.
